You can choose to be a(n) Tobacco :

  • Sole Proprietor,
  • LLC,
  • Corporation or
  • Partnership.
    After you decide and select your business entity, you need licensing.



Columbia Business Tax Registration ( TobaccoBusiness License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.



A(n) Tobacco business using a fictitious business name in Lexington County i.e. you are a business with a trade name other than the owner's legal (full name) name are required to get a(n) fictitious business name.   For instance you open a(n) Tobacco business and you name it "Superior Tobacco Group". You will need to file a fictitious business name for that name.

In SC Tobacco you need a resale ID ( AKA seller's permit) if you selling touchable items.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states). You will need it if you sell or want to buy wholesale any Tobacco related items, such as food, materials, or merchandise.

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.


In addition you will need a federal and a state EIN if you will hire employees. I.e., a SC Federal Tax Id Number ($29) and a(n) SC  State Employer Tax Number  


Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Columbia, Incorporate in SC  or  form a(n) SC LLC


You have a choice to file a DBA or form an LLC or incorporate. If you will do business under your first and last legal name you will not need to get a fictitious business name.
Also note that even using your first and last name may not help you avoid filing a DBA if the name has a suffix such as "& sons" etc.



If you do form an Wholesale Trade llc or incorporate (about $49 plus state fees for most states) your Tobacco business instead of just filing a fictitious business name (dba), it will help you avoid personal liability from wrongs arising from your business dealings and you will not have to file the Columbia business name. In lieu of recording a Lexington County trade company name (our filing service fee includes trade name registration and newspaper legal publication for 4 weeks) you can also form a corporation in SC or form an SC LLC (starts @ $49 plus state fee for most states & includes required documents such as bylaws for the corporation and Limited Liability operating agreement for the LLC). .

A: Hi Adrianna, What you need to buy wholesale your smoke shop items is a wholesale license. It is the same as a seller's permit. The way it works is when you buy wholesale, you present the resale certificate to the wholesaler verifying that you hold a seller's permit. Every quarter, or semi annually, you report what you sold and you keep records and remit the sales tax you collected to the state at the end of the year. Starting a Smoke Shop requires not only state buy also local licenses. For example, you need at least a business license but what is more important is to select a business structure such as an LLC, corporation, partnership or sole proprietorship. If you file an LLC, it will protect your personal assets and register the trade name "Especially Smoke in The Air," so it will be an one shot killing 2 birds. Hiring smoke shop employees requires an EIN from the federal government and an EIN from the state government.
 
 

Online Tobacco Shop Licenses

For an online tobacco shop, you'll need several licenses and registrations to operate legally. These typically include a general business license, a tobacco retailer license, and a sales tax permit. Depending on your location, you may also require a special tobacco distributor or wholesaler license.

Home-Based Business Licenses

  • Tobacco products importer license (if importing)
  • Age verification system certification
  • Tobacco manufacturer registration (if producing tobacco products)


  • You can also obtain a federal tax ID as a sole proprietor and use it as a business tax ID in the place of a social security number. However, you will still need other 
     TOBACCO  registrations, such as licenses, an assumed business name DBA, and tax IDs as described above. Finally, even one person, sole owner/proprietors working from home or just online can form a LLC or incorporate, in which case, they will not need to file a DBA.

  • REQUIRED TOBACCO LICENSES 

    Whether an online, home, store, concession stand or a mobile cart, you will need to first select among
     TOBACCO sole owner/proprietor, partnership, LLC or corporation, all of which also require a General Business License (not a specific license to your type of business) as well. If your trade name is a business name other than your full personal legal name, you will need to file a DBA .

    For instance, your name is John Doe, and you do business as Best 
     TOBACCO Widgets By John, the name must be registered with aDBA Biz Name because it is not your full legal name. Also, note that whatever item that you sell or lease and it is an item that can be touched (i.e.,  TOBACCO  tangible such as equipment, toys,  TOBACCO  merchandise, electronics, prepared food) requires a state sales tax ID ( Sellers Permit ) to either buy or sell the items or products wholesale and or sell them retail. If you are hiring workers anytime soon, you will need a Federal EIN and a State EIN (employer identification number). Other instances that you will need a federal tax ID are: if you are a partnership, an independent contractor, and a corporation or anLLC .
